Terms of Service

1. Acceptance of Terms
These Terms of Service (the "Terms") are a binding agreement between you and Incise Education, LLC, a New Mexico limited liability company ("Incise Education," "we," "us," or "our"), governing your access to and use of the InciseMD website at www.incisemd.com, the InciseMD web application, and all related content, features, and services offered under the InciseMD brand (collectively, the "Services").
By creating an account, purchasing a subscription, or otherwise accessing or using the Services, you accept these Terms and agree to be bound by them. If you do not agree to these Terms, you may not access or use the Services. If you are accepting these Terms on behalf of an institution or other legal entity (for example, a residency program purchasing group access), you represent that you have authority to bind that entity, and "you" refers to that entity.
2. Description of the Services; Eligibility
Incise Education provides a software-based learning platform for medical education, currently focused on examination preparation and continuing study for residents and physicians in plastic and reconstructive surgery, including preparation for in-service and board certification examinations. Incise Education may expand the Services to additional medical specialties, learner levels, and content areas over time, and these Terms apply equally to any such expanded offerings unless we state otherwise.
You must be at least 18 years of age and capable of forming a binding contract to use the Services. The Services are intended for medical students, residents, fellows, physicians, and other healthcare professionals and trainees. The Services are designed for users in the United States; if you access the Services from elsewhere, you do so on your own initiative and are responsible for compliance with local laws.
3. Accounts and Registration
To use most features of the Services, you must register for an account and provide accurate, current, and complete information, and keep that information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Your account is personal to you. You may not share your credentials with, or make your account available to, any other person. We monitor accounts for concurrent or otherwise anomalous logins, and we may suspend or terminate accounts that we reasonably believe are being shared, in accordance with Section 16. Notify us promptly at support@incisemd.com if you suspect unauthorized use of your account.
4. License Grant
Subject to your compliance with these Terms and, where applicable, payment of the required subscription fees, Incise Education grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and the learning materials made available through them (the "Content") for your own individual, non-commercial educational use during your subscription term.
This license permits access from multiple personal devices with non-concurrent sign-ins. No other rights are granted. We reserve all rights not expressly granted in these Terms, and nothing in these Terms transfers any ownership interest in the Services or the Content to you.
5. Subscriptions, Fees, and Payment
Certain features of the Services require a paid subscription. Prices, subscription tiers, and included features are described at the point of purchase. By purchasing a subscription, you authorize us and our third-party payment processors to charge your selected payment method for the fees stated at checkout, plus any applicable taxes.
Free Trial. New subscribers may start with a seven (7) day free trial. A valid payment method is required to begin the trial, but you will not be charged during the trial period. Unless you cancel before the trial ends, your trial converts automatically to the paid plan you selected, and your payment method will be charged the price disclosed at signup on the conversion date disclosed at signup. If you cancel during the trial, you will not be charged. The free trial is limited to one per person; we may modify or withdraw the trial offer prospectively at any time.
If your subscription automatically renews, we will disclose that clearly before purchase, and we will notify you before each renewal as required by applicable law. You may cancel auto-renewal at any time through your account settings or by contacting us at support@incisemd.com; cancellation takes effect at the end of the then-current billing period. Except as provided under the 30-Day Satisfaction Guarantee below, where required by law, or as expressly stated in a posted refund policy, fees are non-refundable, including for partially used subscription periods.
30-Day Satisfaction Guarantee. If you are not satisfied with the Services, you may request a full refund of your first subscription payment within thirty (30) days of the date that payment was charged, by emailing support@incisemd.com from the email address on your account. The guarantee applies once per person, covers only the first payment on your first subscription (not renewal payments or subsequent subscriptions), and takes effect when the refund is issued, at which point your subscription is cancelled and your access to paid features ends. We may deny a refund under this guarantee where we reasonably determine the request is abusive — including where the account has materially violated Section 6 (for example, by copying or distributing Content) or where the guarantee or free trial has been used before under another account.
We may change subscription pricing prospectively. Price changes will not affect a subscription term you have already paid for, and we will give you advance notice of any change that would apply to a renewal, so you can cancel before it takes effect.
6. User Obligations and Prohibited Conduct
You agree to use the Services only for lawful purposes and in accordance with these Terms. In particular, you shall not:
- copy, reproduce, screenshot, scrape, download, record, or otherwise capture the Content, in whole or in part, except for limited personal note-taking that does not substantially reproduce the Content;
- share, publish, post, sell, rent, sublicense, distribute, or otherwise transfer the Content or your access to it, including to question banks, file-sharing services, discussion forums, or social media;
- use the Content or the Services to develop, train, or improve any competing product, dataset, or machine-learning model;
- reverse engineer, decompile, or otherwise attempt to derive the source code, underlying data, or question pool of the Services;
- circumvent or attempt to circumvent any access controls, usage limits, or security measures, or use bots, crawlers, or automated tools to access the Services;
- interfere with the operation of the Services or the use of the Services by others; or
- misrepresent your identity or affiliation, or use another person's account.
Because the value of an examination-preparation platform depends on the confidentiality of its question bank, you acknowledge that unauthorized reproduction or distribution of the Content would cause Incise Education irreparable harm for which monetary damages may be inadequate, and that Incise Education is entitled to seek injunctive relief in addition to any other available remedies.
7. Intellectual Property
The Services and the Content — including all questions, answer explanations, images, illustrations, learning objectives, memory aids, software, design elements, trademarks, and compilations thereof — are owned by Incise Education or its licensors and are protected by United States and international copyright, trademark, and other intellectual-property laws. The "InciseMD" name, the InciseMD logo, and related marks are trademarks of Incise Education, LLC; you may not use them without our prior written consent.
Your subscription is a license to use the Content, not a sale of it. Any unauthorized use of the Content automatically terminates the license granted in Section 4.
8. User Content and Feedback
The Services may allow you to submit content such as notes, flagged-question comments, error reports, support requests, or performance data ("User Content"). You retain ownership of your User Content. You grant Incise Education a non-exclusive, royalty-free, worldwide license to host, store, reproduce, and use your User Content as necessary to operate, maintain, and improve the Services. You represent that your User Content does not infringe the rights of any third party and does not include any patient-identifiable information or other protected health information.
If you provide suggestions, ideas, or other feedback about the Services, you agree that we may use that feedback without restriction or compensation to you.
9. Educational Use Only; No Medical Advice
The Services and the Content are provided for educational and examination-preparation purposes only. They do not constitute medical advice, diagnosis, or treatment, and they are not a substitute for the independent professional judgment of a qualified healthcare provider. The Content is not intended to be used in the diagnosis or management of actual patients, and you must not rely on it for point-of-care clinical decision-making. Clinical information — including techniques, indications, drug dosages, and management algorithms — may be simplified for teaching purposes, may reflect examination conventions rather than current practice, and may become outdated. Always verify clinical information against primary sources and institutional protocols before applying it to patient care.
You must not enter patient-identifiable information or other protected health information into the Services.
10. AI-Assisted Content and Features
Portions of the Content and certain interactive features (such as explanations, tutoring interactions, and study guidance) are generated or assisted by artificial-intelligence systems. Incise Education subjects AI-assisted Content to structural and clinical review processes before publication; nevertheless, AI-generated material can contain errors, omissions, or outdated information. AI-assisted Content is provided for educational purposes only, is subject to the disclaimers in Sections 9 and 13, and should not be treated as authoritative clinical guidance. If you identify an error in the Content, we encourage you to report it through the in-app feedback tools or at support@incisemd.com.
11. Privacy
Our collection, use, and disclosure of personal information in connection with the Services are described in our Privacy Policy, available on our Policies page at https://www.incisemd.com/policies, which is incorporated into these Terms by reference. By using the Services, you acknowledge the practices described in the Privacy Policy.
12. No Affiliation with Examining Boards; Third-Party Marks
Incise Education is an independent commercial education provider. Incise Education is not affiliated with, sponsored by, or endorsed by the American Board of Plastic Surgery (ABPS), the American Society of Plastic Surgeons (ASPS), the Accreditation Council for Graduate Medical Education (ACGME), or any other certifying board, examining body, specialty society, or accrediting organization, and none of those organizations endorses, reviews, or warrants the Content. All third-party names, examination names, and trademarks referenced in the Services are the property of their respective owners and are used solely for identification. Use of the Services does not guarantee any particular examination outcome.
13. Disclaimers of Warranties
THE SERVICES AND THE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, INCISEMD DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. INCISEMD DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE CONTENT IS COMPLETE, CURRENT, OR FREE OF ERRORS.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, any implied warranties are limited to the minimum scope and duration required by law.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, INCISEMD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR EXAMINATION OUTCOMES — ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, INCISEMD'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO INCISEMD FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Incise Education and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your User Content, or (c) your misuse of the Services or the Content, including any unauthorized reproduction or distribution.
16. Term, Suspension, and Termination
These Terms apply for as long as you use the Services. You may stop using the Services and close your account at any time by contacting support@incisemd.com or using the account tools provided in the Services.
We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have violated these Terms — including account sharing or unauthorized copying of Content — or where necessary to protect the Services, other users, or Incise Education's legal interests. Termination for a material violation of Sections 4, 6, or 7 does not entitle you to a refund. Upon any termination, the license granted in Section 4 ends immediately. Sections that by their nature should survive termination (including Sections 7, 9, 10, and 13 through 19) will survive.
17. Modification of Terms and the Services
We may revise these Terms from time to time. If we make material changes, we will provide reasonable advance notice — for example, by email to the address on your account or by prominent notice within the Services — before the changes take effect. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the revisions; if you do not agree, you must stop using the Services and may cancel your subscription as described in Section 5.
We may also modify, add, or discontinue features of the Services. If we discontinue a paid feature material to your subscription during a period you have already paid for, your remedy will be a pro-rata refund for the unused portion attributable to that feature.
18. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. The state and federal courts located in Bernalillo County, New Mexico shall have exclusive jurisdiction over any such dispute, and each party consents to personal jurisdiction and venue in those courts. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for infringement or misuse of intellectual property.
19. Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy and any order or subscription terms presented at purchase, constitute the entire agreement between you and Incise Education regarding the Services and supersede all prior agreements on that subject.
Severability; Waiver. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. A failure to enforce any provision is not a waiver of the right to enforce it later.
Assignment. You may not assign or transfer these Terms or your account. Incise Education may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
Force Majeure. Incise Education is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including outages of third-party hosting, network, or payment providers.
Notices. We may provide notices to you by email to the address associated with your account or through the Services. You may provide notices to us at the contact information below.

Privacy Policy

1. Introduction
This Privacy Policy describes how Incise Education, LLC, a New Mexico limited liability company ("Incise Education," "we," "us," or "our"), collects, uses, and shares personal information when you visit www.incisemd.com, use the InciseMD web application, or otherwise interact with our services (collectively, the "Services"). It applies to prospective, current, and former users.
By using the Services, you acknowledge the practices described in this Privacy Policy. This Policy is incorporated into our Terms of Service. If you do not agree with it, please do not use the Services.
2. Information We Collect
Account information. When you register, we collect your email address and authentication credentials. Passwords are handled by our authentication provider and are never stored by us in readable form. You may optionally provide profile details such as your name, training level, institution, or specialty.
Study and performance data. As you use the Services, we collect the learning activity needed to operate them: questions attempted, answers selected, scores, timing, session history, flagged questions, notes, self-assessments, and derived performance metrics (for example, per-topic mastery estimates used to personalize your study plan).
Communications. If you contact support, submit in-app feedback, or report a content error, we collect the contents of that communication and the contact information you provide.
Social media interactions. If you interact with our Instagram account (for example, by replying to one of our quiz Stories or sending us a direct message), we receive, through Meta's Instagram Platform, your Instagram-scoped user identifier and the content of the messages you send us. We use this information solely to respond to you with educational content — such as the correct answer, an explanation, and a supporting citation — and to compile aggregate, non-identifying statistics about how our quiz questions are answered. You can stop receiving automated replies at any time by messaging us the word "STOP." Information you share with us on Instagram is also subject to Meta's own Privacy Policy (https://privacycenter.instagram.com/policy). We do not use Instagram data for advertising, and we do not sell it.
Mailing list information. If you sign up for product updates, we maintain your email address on our mailing list until you unsubscribe.
Payment information. Payments are processed by Stripe, Inc. ("Stripe"). When you purchase a subscription, your card details are provided directly to Stripe and are governed by Stripe's own privacy policy (https://stripe.com/privacy). We receive limited transaction information from Stripe (such as subscription tier, transaction date, billing status, and card type and last four digits) but never receive or store your full card number.
Technical and log data. Our hosting and infrastructure providers automatically log technical information such as IP address, browser type, device type, pages requested, and timestamps, which we use for security, debugging, and operations.
We do not collect, and you must not submit, patient-identifiable information or other protected health information. The Services are a personal study tool and are not intended to receive clinical data about any patient.
3. How We Use Information
We use the information described above to:
- provide, maintain, and personalize the Services, including adaptive study features that depend on your performance history;
- authenticate you and secure your account;
- process subscriptions and payments (when offered);
- respond to support requests and content-error reports;
- send transactional messages (such as account, billing, and renewal notices) and, with your consent or as otherwise permitted by law, product updates you can opt out of at any time;
- monitor, debug, and improve the Services, including analyzing aggregated or de-identified usage patterns; and
- comply with legal obligations and enforce our Terms of Service.
We do not use your personal information for third-party advertising, and we do not sell it.
4. AI Features and Your Data
Certain features of the Services — such as answer explanations, tutoring interactions, and study guidance — are powered by third-party artificial-intelligence providers. When you use these features, relevant inputs (for example, the question at hand, your answer, or your typed interaction) are transmitted to those providers for processing on our behalf. We use providers whose API terms restrict use of submitted data to providing the service to us and do not permit training their general-purpose models on it. We do not send your account credentials to AI providers, and you should not enter patient information or other sensitive personal information into AI-powered features.
5. How We Share Information
We do not sell personal information, and we do not share it with third parties for cross-context behavioral advertising. We share personal information only with:
- Service providers that process data on our behalf under contractual restrictions, currently including: cloud application and database hosting, authentication services, email delivery and mailing-list management, AI processing providers (as described in Section 4), and Stripe for payment processing;
- Legal and safety recipients, where disclosure is reasonably necessary to comply with law or legal process, enforce our agreements, or protect the rights, safety, or property of Incise Education, our users, or others; and
- A successor entity, in connection with a merger, acquisition, financing, or sale of assets, in which case this Policy will continue to apply to previously collected information unless you are notified otherwise.
6. Cookies and Local Storage
The Services use only functionality-essential technologies: authentication tokens set by our authentication provider to keep you signed in, and browser local storage used to save your study sessions, cached question data, and preferences on your own device so the application works quickly and offline. In addition, our payment processor, Stripe, sets its own cookies and collects device information on payment pages as needed for payment processing, security, and fraud prevention; that processing is described in Stripe's privacy policy. We do not use third-party analytics cookies, advertising cookies, or cross-site tracking technologies. If that changes, we will update this Policy and, where required, request your consent. Because we do not engage in cross-site tracking, the Services do not respond differently to browser "Do Not Track" signals.
7. Data Retention
We retain account and study data for as long as your account is active, so that your performance history and personalization continue to work. If you close your account or request deletion, we delete or de-identify your personal information within 90 days, except where retention is required for legal, security, or financial-record purposes (for example, transaction records). Backup copies may persist for a limited additional period before being overwritten in the ordinary course.
8. Security
We use commercially reasonable technical and organizational safeguards, including encryption of data in transit, hosted infrastructure with access controls, row-level access restrictions in our database, and credential handling through an established authentication provider. No system is perfectly secure; you are responsible for keeping your login credentials confidential, and we will notify affected users of any data breach as required by applicable law.
9. Your Choices and Rights
- Access, correction, deletion. You may request a copy of, correction of, or deletion of your personal information by contacting us at support@incisemd.com. We will verify your request using the email associated with your account and respond within the time required by applicable law.
- Marketing opt-out. Every product-update email includes an unsubscribe link; transactional messages (such as billing and renewal notices) are sent as long as you maintain an account or subscription.
- State privacy rights. Depending on your state of residence (including California, Colorado, Connecticut, Texas, Virginia, and others with comprehensive privacy laws), you may have additional statutory rights, such as the right to know, delete, correct, or port your data, and the right not to receive discriminatory treatment for exercising those rights. We honor such requests as described above regardless of whether a given statute's applicability thresholds are met. We do not sell personal information or share it for targeted advertising, so there is no need for a "Do Not Sell or Share" opt-out.
- Appeals. If we decline a rights request, you may appeal by replying to our decision, and we will re-review it.
10. Children
The Services are intended for adults in medical training and practice. We do not knowingly collect personal information from anyone under 18. If we learn that we have done so, we will delete it.
11. Not a HIPAA Service
Incise Education is an educational-technology company, not a healthcare provider, health plan, or business associate, and the Services are not designed to create, receive, maintain, or transmit protected health information under HIPAA. Do not enter patient information into the Services.
12. International Users
The Services are operated from the United States and intended for U.S. users. If you access the Services from outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from those of your jurisdiction.
13. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide reasonable advance notice — for example, by email or prominent notice within the Services — before the changes take effect. The "Last Updated" date at the top reflects the current version.

Subscription & Cancellation Policy

Subscription Terms
InciseMD subscriptions are provided by Incise Education, LLC ("we," "us"), the operator of the InciseMD platform, in the tiers, prices, and billing periods shown at checkout. Unless a plan is expressly labeled non-renewing, your subscription automatically renews at the end of each billing period, and the payment method you provided will be charged the then-current renewal price plus applicable taxes, until you cancel.
Before you purchase, the checkout page states the price, the billing frequency, whether and when the price can change, the date of your first charge, and — if your plan includes a free trial or promotional rate — the date the trial or promotion ends and the amount you will be charged afterward. You will not be enrolled in automatic renewal without your express consent.
Free Trial
New subscribers may start with a 7-day free trial. A payment method is collected at signup, but you are not charged during the trial. Unless you cancel before the trial ends, the trial converts automatically to the plan you selected, and your payment method is charged the price disclosed at signup on the conversion date shown at signup and in your signup confirmation email. We will email you a reminder before the first charge. If you cancel during the trial — in Account → Subscription or by emailing support@incisemd.com — you will not be charged. One free trial per person.
How to Cancel
You may cancel at any time, and cancellation is available in your account: Account → Subscription → Cancel Subscription. Cancellation takes effect at the end of the current billing period; you keep access until then. You may also cancel by emailing support@incisemd.com from the address on your account. We do not require a phone call, chat session, or retention conversation to cancel.
Refunds and 30-Day Satisfaction Guarantee
30-Day Satisfaction Guarantee. If you are not satisfied with InciseMD, email support@incisemd.com from the address on your account within 30 days of your first subscription charge and we will refund that payment in full. The guarantee applies once per person and covers your first payment only — renewal payments and later subscriptions are not covered. When the refund is issued, your subscription is cancelled and paid access ends. We may decline refund requests we reasonably determine to be abusive, as described in the Terms of Service.
Apart from the guarantee, and except where required by law or expressly stated otherwise for a specific offer, payments are non-refundable, and cancelling does not generate a refund for the remainder of the current billing period. If we discontinue a paid feature material to your subscription mid-period, we will issue a pro-rata refund for the unused portion attributable to that feature, as described in the Terms of Service.
Price Changes
Renewal prices may change prospectively. If the price of your plan increases, we will notify you by email at least 30 days before the renewal in which the new price takes effect, so you can cancel before being charged the new amount.
Renewal Reminders
For subscription terms of one year or longer, we will email you a renewal reminder 15–45 days before the renewal charge. For free trials longer than one month, we will email you 3–21 days before the trial converts to a paid subscription. All reminder emails identify the product, the renewal price and date, and how to cancel.
